eSell – Terms and Conditions and Disclaimer

By using the eSell platform you accept the terms and conditions set out below. If you do not agree to these terms and conditions, please do not use the eSell platform.
1. General Terms
• eSell is an online marketplace/platform, which acts only as an intermediary to connect local buyers and sellers with each other.
• While creating an account, users must provide accurate, complete and up-to-date information including their name, mobile number and other required information.
• eSell itself is not a buyer or seller and does not directly own, buy or sell the products or services listed by users on the platform.
• The user shall be responsible for the security of his/her account and the activities carried out through it.
• Users shall not share his/her account login details, OTP, password, UPI PIN or other sensitive information with any other person.
• eSell reserves the right to remove or edit any listing that contains false, incomplete, misleading or otherwise infringing information.
2. Listing Rules
2.1 Accurate Information
The seller must provide the following information about the item or service listed as accurately and completely as possible:
• Actual and clear photographs of the item
• Selling price
• Whether the item is new or used
• Details of the item’s condition and any defects, if any
• Appropriate specifications and other relevant information
• Details of ownership or legal documents where required
A seller may not post false, misleading, deceptive or fraudulent advertisements.
2.2 Prohibited Items
Listing or selling of the following items is strictly prohibited on eSell:
• Weapons or illegal weapons
• Narcotics or illegal intoxicants
• Stolen items
• Illegal items or services
• Counterfeit or counterfeit products
• Any other item or service prohibited under applicable law
Users must comply with applicable laws and regulations of India while using eSell.
2.3 Appropriate Category
All items should be listed under the appropriate category, such as:
• Electronics
• Furniture
• Vehicles
• Property
• Mobile & Accessories
• Home Appliances
• Other relevant categories
eSell reserves the right to move, edit, remove or take appropriate action against the account for listings placed in inappropriate categories.
3. Purchase, Transaction and Payment
3.1 Personal Inspection
• Buyers are strongly advised to personally inspect and verify any item before purchasing it.
• Buyers should independently verify the condition, ownership, documents, specifications, authenticity and other relevant details of the item.
• Buyer should make a purchase decision only after being satisfied with their verification.
3.2 Payment
• eSell only provides a platform to connect buyers and sellers.
• Payments and other financial transactions between the buyer and seller are made directly between the two parties.
• eSell does not collect, hold, process or guarantee payments between the buyer and seller, unless a specific paid payment service is separately made available by eSell.
• eSell does not guarantee the success of any transaction or receipt of payment.
• Users should exercise special caution while making online payments.
• Do not share OTP, UPI PIN, ATM PIN, password, CVV or banking credentials with anyone.
4. Refund, Return and Cancellation
• eSell is not a party to the direct transaction between the buyer and seller.
• Therefore, the decision and arrangement regarding the return, refund, exchange or cancellation of an item will generally be between the buyer and the seller.
• eSell does not guarantee a refund or return for sales made by a third-party seller.
• If eSell announces a separate refund or cancellation policy for any of its paid services in the future, the relevant policy will apply to that service.
• Before making any transaction, the buyer and the seller should clarify the return, refund, cancellation and other terms and conditions with each other.
5. Fraud, Scam and Security
Users are advised to take the following precautions to avoid online fraud:
• Do proper verification before making advance payment to an unknown person.
• Do not give OTP, UPI PIN, password or banking details to anyone.
• Be cautious if someone asks for payment or OTP in the name of eSell.
• Report suspicious or fraudulent listings to eSell.
• Do not transact if any listing or seller seems suspicious.
If eSell detects fraud, scam, misleading information or other suspicious activity, it reserves the right to remove the listing, suspend or block the account, and take appropriate action as per applicable law.

6. Special rules for vehicles
When buying or selling a bike, scooter, car or any other used vehicle:
• The buyer should independently verify the RC/Registration Certificate, insurance, ownership details and other necessary legal documents.
• Properly verify that the vehicle is not stolen.
• Verify if there is any outstanding loan or hypothecation.
• Verify pending challans, tax or other pending legal obligations.
• The buyer should verify the actual condition of the vehicle and available documents.
• Follow the applicable procedures and rules of the RTO regarding the transfer of ownership of the vehicle.
• eSell will not be responsible for any dispute related to the ownership, condition, documentation, registration, loan, challan or ownership transfer of the vehicle.
7. User Responsibilities
Users:
• Will use eSell legally and responsibly.
• Will not provide false or misleading information.
• Will not post false or fraudulent advertisements.
• Will not attempt to defraud or harm other users.
• Will not list illegal goods or services.
• Will not illegally use another person’s private information.
• Will not illegally use another person’s copyrighted photographs, logos, trademarks or other intellectual property.
• Will not use the platform for spam, fraud, harassment or other illegal purposes.
The user will be solely responsible for the listings, photographs, information, offers and other content posted by the user on the platform.
8. Listing Content and Intellectual Property
• The seller must have the necessary rights or permission for the photos, descriptions, logos and other content used in his/her listing.
• Posting content that infringes the copyright, trademark or other intellectual property rights of any person is prohibited.
• eSell’s name, logo, design, software, content and other proprietary materials may not be used commercially or illegally without eSell’s permission.
• eSell shall have the right to remove content that violates the Terms & Conditions.
9. Account Suspension and Termination
eSell may suspend, restrict, remove or block any account or listing in the following situations:
• False or fraudulent information is provided.
• Illegal items are listed.
• Misuse of the platform.
• Defrauding other users.
• Violation of these Terms & Conditions.
• Violation of applicable laws or regulations.
Even after an account is closed or blocked, obligations related to previous transactions, payments, disputes or legal obligations may continue for as long as necessary.

10. Privacy Policy
• The collection, use, storage and processing of personal information collected by eSell from users will be in accordance with eSell’s Privacy Policy.
• Users should read and understand eSell’s Privacy Policy.
• Further details regarding the use and protection of personal information will be provided in the Privacy Policy.
11. Complaints and Reports
• Users may report any suspicious, fraudulent, misleading or prohibited listing to eSell.
• While making a complaint or report, as much correct and relevant information as possible should be provided.
• eSell shall have the right to investigate the complaint received and take appropriate action.
• eSell does not guarantee a specific outcome or action to be taken in every complaint.
12. Applicable Law and Dispute Resolution
• These Terms & Conditions and the use of eSell’s platform shall be subject to applicable Indian laws and regulations.
• In case of any complaint or dispute, the user should first try to resolve the issue by contacting eSell directly.
• If the dispute is not resolved amicably, appropriate legal process may be adopted in accordance with applicable law.
• Specific details regarding jurisdiction shall be determined by consulting legal counsel in accordance with eSell’s business registration and applicable law.
13. Changes to Terms & Conditions
• eSell shall have the right to change, amend or add to these Terms & Conditions from time to time.
• Revised Terms & Conditions shall be effective upon publication on the platform.
• Users shall be responsible for periodically checking the Terms & Conditions.
• Continued use of the platform after any changes to the Terms & Conditions shall constitute acceptance of the revised Terms & Conditions, subject to the limitations of applicable law.
